Statement of Donald Cameron Ferguson about the death of his wife Helen Ferguson nee Kendall:
This Deponent Donald Cameron Ferguson on his oath saith, I am a Labourer residing at Lexton.
The deceased Helen Ferguson was my wife. I last saw her alive 8.30 am on the 22nd day of June 1902. She had sit down at the table to have breakfast. Shortly after her sitting down I heard a gurgling sound in her throat. I, with my children at once attended to her removed her to bed where she immediately expired.
The deceased was 68 years of age and has been suffering from paralysis for about 15 years.
I have had her examined frequently by a medical man. The last occasion was about 3 years ago. Dr. Cunningham of Talbot examined her then and said that he could do nothing for her. He also said that she was not to be left alone as she would die at any time. She has been helpless for a long time.
Deceased and I were on good terms and never quarreled and I have been expecting her death for the last 3 years.

LEXTON POLICE COURT
A case of considerable interest locally was heard at the above court on the 26th inst, when Donald Ferguson was charged by Jonas Simpkin for trespassing on a certain piece of land at Lexton viz., No 1 allotment, corner of Lindsay Street.
Jonas Robert Simpkin sworn, stated that on or about the 20th June last he found defendant in the act of erecting a house or rough building on the allotment named. Had called on defendant personally and warned him off the ground and told him if he persisted in trespassing he would take action against him. The defendant had been trespassing ever since and had erected a tent on the land and been residing there. On another occasion he met the defendant who said he would leave the ground if he (complainant) could show his authority, and also said it would be no use to summon him to the County Court as be bad no claim to the land. Complainant also stated that his father had fenced in the land with a brush fence, in 1872 and the fence was washed away by a food in 1873 he fenced it in again in 1885 and it was again fenced with a substantial wire fence in 1887 ; was never interfered with; had improved the land ; and had paid rates on it and handed the bench the last receipts for same. Donald Cameron Ferguson sworn, stated that he was on the land at the time mentioned because he thought he had a right there. He was living in a tent, dwelling in the wilderness as it were. He took possession of the land on behalf of his wife whose brother, John Kendall, who died 19 years ago, was the original owner of the land. On the death of [[Kendall-904|John Kendall] the land had passed to his father and mother and after the old people died about 12 years ago his wife, as next of kin, thought she had a legitimate claim to the land, and to support his statement he handed documents to the Bench from the Lands Office, etc. which proved that the Crown grant of the land in John Kendall's name was lying at the Titles Office, in Ballarat, and there was £1 0s 2d to pay on it and steps were being taken to have the same transferred. Cross examination — Had paid no rates on the land. Had no object in interfering before. Had offered the Engineer rates but he had refused to take it as the amount would be so small. Complainant had not improved the land with the exception of taking out three scrub bushes (it might he six) he believed the complainant had fenced in the land about 8 years ago. The Bench, consisting of Mr Leader, P.M , and Messrs R. W. Grayling, Thos. Robertson and Jos. Lavery, after a lengthy retirement, dismissed the case without costs.
